Revised Statutory Guidance under Part 2A of Environmental Protection Act 1990

An appraisal of the statutory guidance accompanying Part 2A of EPA 1990 commenced in 2011 as part of the Government’s challenge to cut “red tape”. The revision was laid before Parliament in February 2012 following industry consultation which LEAP were involved in. It came into force in April 2012.

The changes are billed by DEFRA as allowing “regulators to make quicker decisions about whether or not land is contaminated under Part 2A”, while “still taking a precautionary approach”.

It is certainly the case that some costly remediation operations have been undertaken unnecessarily in the past, and the revised guidance aims to address this. Whether these laudable objectives are achieved remains to be seen, but Leap Environmental are at the forefront of understanding how the new guidance affects the Part 2A regime, and have already been involved in reconsideration of schemes in light of the revision.
